ERIN'S LAW

As parents/ guardians, it’s our top priority to send our children into the world as healthy, blossoming adults. However we are all-too-aware of the potential real-world dangers which threaten the safety of our children. Though it is our sincerest hope they will never encounter these dangers, we know we must equip them with the proper and adequate defenses, just in case.

Stop Child Abuse and Neglect (SCAN) is a program from Family Services Association in Moraine, Ohio. We are passionate about safeguarding children from harm, specifically from the harm caused by child sexual abuse. For more than twenty years, SCAN has been training parents and children to prevent and protect against child sexual abuse (CSA). I Can Tell is a trauma-informed, CSA-prevention program created by SCAN to empower children to protect themselves from risks and abuse. As of May 2024, over 35,000 children have been trained in I Can Tell; and more children are trained each month!

SCAN is offering I Can Tell at your child’s school. Each training is facilitated by trauma-informed, prevention-credentialed staff who are passionate, nurturing and upbeat. During the 45- 60 minute program, they will teach your child the following:

*Trusted Adults are the adults in our lives we know will listen to us and provide us the safety we need. Anytime we feel uncomfortable or unsafe, we can go to a Trusted Adult for help and protection.

*We are allowed to say “no” to anyone who wants to look at or touch us. Our bodies belong to us, so we get to choose who touches us and how. If anyone makes us feel uncomfortable or unsafe, we can find a Trusted Adult.

*Good secrets make us feel happy and excited, and are about something that makes us/others feel good; Bad secrets make us feel uncomfortable and unsafe, and are about something hurtful or dangerous. Read More

Notice Regarding Homeless Students
The Miamisburg School Board believes that all school-aged students, including homeless students, have a basic right to admission in the Miamisburg School District and equal educational opportunities. Accordingly, the district must enroll each homeless student in our district in the school determined to be in the student’s best interest. The Miamisburg School District’s homeless liaison is Casey Hess. Ms. Hess can be reached at 937.866.3381 Ext. 3006. For more information regarding Board Policy File: JECAA, visit the district website at www.miamisburgcityschools.org.

Identification of Children with Disabilities
All students with disabilities living within the district are identified, evaluated and placed in appropriate educational programs. The District’s responsibility to identify and evaluate children with disabilities also includes children whose parents have placed them in a non-chartered, non-public school within Miamisburg City School’s geographic area regardless of where the parent resides.

Federal laws, specifically IDEA (Individuals with Disabilities Education Act) and Section 504 of the Rehabilitation Act, also requires this identification. Due Process requirements, procedural safeguards and confidential treatment of information are adhered to as required by State and Federal law.

Disability conditions include multiple disabilities, hearing or vision, orthopedic and/or other health disabilities. Also included are severe behavior, cognitive disabilities, specific learning disabilities, speech and language disabilities and autism.

If you have any questions concerning a preschool or school-age child suspected of having a disability, please contact Katy Lucas - Director of Student Services - 540 E. Park Avenue, Miamisburg, Ohio 45342 or by phone at 937.866.3381 Ext. 3017.

Use of Student Records
School officials have access to student records for legitimate educational purposes. “Official personnel” and “legitimate educational interest” are both clearly defined in the Board Policy File: JO-R. Please call 937.866.3381 if you have any questions.

Student Records Annual Notification
Proper administration of student records is very important to Miamisburg City Schools. The Board Policy Section J: Policy JO, “Student Records” outlines the district’s procedures for the collection and use of student records.

The district annually publishes a notice to parents and eligible students for their rights under State and Federal law. Notices can be found on the district website www.miamisburgcityschools.org and in the student handbooks.

Parents and eligible students have:

  1. the right to inspect and review the student’s education records;

  2. the right, in accordance with administrative regulations, to seek to correct parts of the student’s education records, including the right to a hearing if the school authority decides not to alter the records according to the parent(s)’ or eligible student’s request;

  3. the right of any person to file a complaint with the U.S. Department of Education if the District violates relevant Federal law, specifically the Family Educational Rights and Privacy Act and

  4. the right to acquire information concerning the procedure which the parent(s) or eligible student should follow to obtain copies of this policy, the locations from which these copies may be obtained, as well as any fees to be charged for such copies.

Parents or eligible students should submit to the student’s school principal a written request, which identifies as precisely as possible the record or records that he/she wishes to inspect. The principal (or other custodian) makes the needed arrangements as promptly as possible and notifies the parent or eligible student of the time and place where the records may be inspected. This procedure must be completed within 45 days or earlier after the receipt of the request.

Restraint and Seclusion Annual Notification
The District implements Positive Behavioral and Intervention Supports (PBIS) on a systemwide basis. These supports are embedded into each building’s day to day practices and procedures as a way to proactively address incidents that may result in disciplinary action. The District encourages family involvement as an integral part of its PBIS system. The board policy specifically states that physical restraint or seclusion may not be used as a form of punishment or discipline, or as a substitute for other less restrictive means of assisting a student in regaining control. The use of prone restraint is prohibited. Restraint and/or seclusion may be used by trained personnel if a student's behavior poses an immediate risk of physical harm to the student or others and no other safe or effective intervention is available. Please refer to MCS Board Policy File:JP Positive Behavioral Interventions and Supports (Restraint and Seclusion) posted on our website for more information.
